My Terms and Conditions of Services

In the following terms & conditions "the photographer" shall mean Nancy Vaughan operating as Red hawk Photography. "The clients" shall be those persons defined as such on the scope of work above. These terms & conditions cannot be varied in any way by the clients unless such conditions are expressly agreed by the photographer in writing.

0. ACKNOWLEDGEMENT AND AGREEMENT

1. At or prior to the time of booking the Photographer will advice client(s) to go to this website (redhawkphotography.net) and review these terms and conditions. It is the client(s)'s responsibility to read them fully. The client is bound to these terms and conditions once advised of such and it is up to the client to read and fully understand them.

1. COPYRIGHT

The copyright Designs and Patents Acts assign the copyright of the images to the photographer.

2. DISPLAY

The client(s) hereby allow(s) the photographer to display any photograph covered by this contract and to generally promote the business in advertising, brochures, magazine articles, websites, sample albums, social media, etc.

3. CREATIVE LICENSE, COVERAGE AND REPRODUCTION

1. Photographs taken during the course of the event will be at the discretion of the photographer although, every effort will be made to comply with the clients requirements. If a 'shot list' is given during discussions before the event, these shots will be given priority, but are not a guarantee.

2. Special requests are not binding instruction, although every effort is made to comply with the clients's wishes. The Photographer will do her best to honor the requested photographs, but understand there are environmental and other factors that effect the Photographer's ability to get the shot. Things like weather, background, location and willingness of subjects are all factors in how the photograph turns out and in what photographs can be taken.

3. For a booking involving a church ceremony or at certain venues, the Photographer's movements are at times restricted by the official in charge. The Photographer will do her best to get good vantage points but realize, this may not always be ideal nor the Photographer's first choice for a camera angle. The Photographer does not accept responsibility for restrictions or obstructions of view in such cases.

4. Due to various lighting conditions and the limitations of digital sensors, some colors may alter throughout a set of photographs. The photographer does editing and will do her best to get the best color she can for your photographs, but variations in color may exist.

5. All equipment is checked regularly and tested the day of the event. Backup equipment is always taken to a shoot. However, the Photographer will not be responsible for photographs that are not produced due to technical failure.

4. PAYMENT

1. A non-refundable booking fee of 20% of the full fee or $100 deposit is required to confirm a booking, at photographers discretion. For smaller photo sessions, the deposit fee may be waved at the Photographer's discretion. When you confirm your session/event you accept the terms and conditions published here.

2. For sessions/events payment in full is due at the time of the session/event. Digital photos and/or prints will only be turned over when payment in full is received. Titles to all goods remain with the photographer.

3. Any prints must be paid for in full at time of order.

4. At the discretion of the photographer full payment be deemed necessary before the photoshoot. If any of these terms need to be invoked the photographer may do so at her discretion.

5. FORCE MAJEURE

1. In the very unlikely event of cancellation by the Photographer or of total photographic failure, liability shall be limited to a full refund of any fees paid to the Photographer for said event.

2. The Photographer will endeavor to put the client(s) in touch with another photographer in the event she is unable to attend on the wedding date due to any cause beyond her reasonable control e.g. sudden illness, injury, victim of crime, flooding, traffic conditions, vehicle breakdown, etc.

6. DIGITAL NEGATIVE FILES

1. All digital negatives (computer and camera digital files) remain the property of the Photographer. All digital photos include a copy of the edited digital negatives turned over to the client(s) are for their own personal use and may not be resold, in any form, without the Photographer's written permission and are based on Photographer's terms and conditions.

2. Should the digital negative files be lost, damaged or destroyed for reasons beyond control, the Photographer's liability shall be limited to a full refund of any deposit and fees paid to the Photographer, but shall not include a refund for any goods already received.

3. In the event a client is needing a secondary copy of digital photos past receiving a copy of the digital proofs and after payment of the invoice, a secondary payment will be required at the Photographer's discretion.

7. ON THE DAY

1. The Photographer will be the sole professional (still) photographer at the venues specified. This can be otherwise negotiated but must be done prior to the event. For larger events Nancy Vaughan, Photographer, can contract out for an additional photographer if she deems it necessary.

2. The Photographer does encourage other guests to take photographs throughout the event, and only at times, will try to ensure said guest does not interrupt or interfere with key photographs being taken by the Photographer.

3. The Photographer will arrive to the event in a timely manner. This is only restricted by events beyond the photographers control, examples being severe weather, vehicle breakdown or traffic conditions like accidents or road closures. The Photographer will stay beyond the booking duration at the Photographer's discretion only. Once the agreed upon duration of the event booking is over any additional time is solely at the discretion of the Photographer, unless expressly agreed upon in writing prior to the event.

8. PERSONAL ACCIDENT OR DAMAGE/LOSS OF PROPERTY

1. Any directions issued to clients, their guests or employees during a photographic shoot are deemed to be at the said person's own risk. This includes studio or location/event shooting. The Photographer cannot be held responsible for any personal accidents or injury during a photographic shoot. This extends to any incidents or accidents in transit to the photographic event and after.

2. Please take precautions to secure your personal property. Lock your car and keep your valuables safe. The Photographer is not responsible for damage or loss of property before, during or after the photography session. Please arrive and leave safely.

9. CANCELLATION FEES

1. If the client(s) should have to cancel a booking the following cancellation fees will become due immediately upon said cancellation:

a. Deposit fee is lost to the client and remains the Photographer's. Please realize the Photographer has potentially turned down other paying jobs to hold your date and will be losing the entire event fee. Keeping the deposit is a small compensation for this loss.

10. DELIVERY

1. The Photographer will endeavor to deliver digital negative files as quickly as possible, one month after the session/event is typical during really busy time periods. The Photographer will do everything she can to get your digital files to you quickly and often this occurs in less than a month, but depending on the size of your event and number of events scheduled to could take a month to 6 weeks to get your digital photo copies to you.

Your privacy is important to us. The only personal information we collect is name, street and email address and telephone number. Your credit card information may be collected if that form of payment is used to make your purchase but, that data is only used to process your transaction and is never stored in our database.

Your personal information is used to contact you regarding your photographs, setting up sessions or events and other related products or services and processing any transactions you may do with Nancy Vaughan, Photographer. Such personal information is only used in relation to services provided by Nancy Vaughan, Photographer, and is never shared, sold or used for other purposes. Appropriate physical, electronic and managerial procedures are in place to safeguard and secure your information. Your information is never stored on our website.
